Marriage and Cohabitation Agreements
Marriage and Cohabitation Agreements are made before or during cohabitation or marriage to organize financial affairs and agree on what will occur upon a breakdown of the relationship.
Divorce
Although obtaining a divorce is a relatively simple matter; it is the related legal issues such as spousal support, child support, parenting arrangements and division of property which require the expertise of a family lawyer.
Parenting
Parenting refers to the arrangements which define the respective responsibilities of each parent for major life decisions and living arrangements of their child(ren) following divorce or separation.
Child Support
Children are entitled to child support pursuant to the law, the amount of which is determined by a number of factors and in accordance with Provincial guidelines.
Spousal Support
Depending on circumstances during, and at the end of, a marriage, a spouse may be entitled to spousal support, the amount and duration of which are determined by a number of factors including Spousal Support Advisory Guidelines.
Property Division
Ontario uses an equalization regime to divide marital property. The net value of family property owned by each spouse on the valuation date is calculated and the difference between spouses’ values is split evenly.
Enforcement
If there is a failure to pay child or spousal support required to be paid in accordance with an agreement or court order, the obligation to pay may be enforced by a government agency called the Family Responsibility Office.
Alternative Dispute Resolution
Through alternative dispute resolution processes, such as mediation or arbitration, disputes can generally be resolved with less cost, time and conflict than traditional court resolution.
